Terms of service
These terms are an agreement between you and GoatGauge (“GoatGauge”, “we”, “us”) for using the GoatGauge apps and the website at goatgauge.com (together, “GoatGauge”). By creating an account or using GoatGauge you agree to them. Our privacy policy explains how we handle your personal data.
1. Who can use GoatGauge
- You must be at least 16 years old.
- You must give accurate details and keep your sign-in secure. You’re responsible for what happens in your account. Tell us straight away at support@goatgauge.com if you think someone else has used it.
- One person per account. You can’t sell or transfer your account.
2. Training and your health
GoatGauge is a tool for planning and logging exercise. It isn’t medical advice, and coaches on GoatGauge aren’t acting as medical professionals through it. Exercise carries a risk of injury. Check with a doctor before starting a new program, especially if you have a health condition, are pregnant or haven’t exercised for a while. Stop and get help if you feel pain, dizziness or shortness of breath. You train at your own risk, and you’re responsible for choosing loads and exercises that are safe for you.
3. Programs, coaches and organisations
- Programs are created and sold by independent coaches, gyms and other organisations (“sellers”). The seller is responsible for their program, coaching, events and messages. GoatGauge provides the platform and isn’t a party to the coaching relationship.
- A coached program lets the organisation’s coaches see your training and check-ins only if you allow it. See the privacy policy.
- Sellers may publish new versions of a program. You choose whether to move to a new version; what you bought stays available to you.
- An organisation may add you to a program directly. It can end that access, and your data stays yours.
4. Buying programs
- In the apps, purchases and subscriptions are made through the App Store or Google Play and are also governed by Apple’s or Google’s terms. Refunds for those purchases are handled by Apple or Google under their policies.
- On the web, payments are processed by Stripe.
- Prices are shown before you buy and include any VAT that applies.
- One-off purchases give you ongoing access to the program for as long as GoatGauge offers it, unless it’s refunded or we have to remove it (see section 8).
- Subscriptions (including all coached programs) renew monthly until you cancel. Cancel any time in your App Store or Google Play account settings, or for web purchases from your account. Access continues until the end of the period you’ve paid for.
- Free tasters are short samples of a paid program. Each can be claimed once per account and ends after its set time.
- Your right to cancel: programs are digital content. When you buy one, you ask for access to start straight away and agree that you lose the 14-day right to cancel once access starts. This doesn’t affect your rights if a program is faulty or not as described.
- If a refund or chargeback is made, access to the program ends.
5. Selling on GoatGauge
If you create an organisation and sell programs, these extra terms apply.
- You must have the right to sell everything in your programs and events, and they must be accurate, safe and lawful. You’re responsible for the coaching you provide and for any qualifications or insurance your work requires.
- GoatGauge sells programs on your behalf to buyers. We collect payment, and pay you your share of each sale less the app store or payment fee and GoatGauge’s commission. The current commission is 5% of the sale price; we’ll give you at least 30 days’ notice of any change.
- Your earnings become payable once the store has paid us and the refund window has passed (currently 75 days after the sale), and are paid to your bank through Stripe Connect when your balance reaches the minimum (currently £10). You must complete Stripe’s onboarding and agree to Stripe’s terms to receive payouts. Refunds and chargebacks are deducted from your balance.
- Client billing: organisations pay for clients they add to their programs directly. Each such client who is active for more than 2 hours in a calendar month costs £2 for that month, billed monthly by Stripe. Clients who buy a program themselves, or are removed within the first 2 hours, aren’t charged. If a bill isn’t paid within 7 days, you can’t add new clients until it is; existing clients keep their access.
- You must keep your clients’ data confidential and only use it to coach them, as the privacy policy describes.
- We may hold payouts while we investigate a report, a suspected breach of these terms, fraud or a dispute.
6. Your content
You keep ownership of what you create and upload, such as programs, exercises, messages, photos, videos, reviews and events. You give GoatGauge a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and adapt it, only as needed to run, show and improve GoatGauge and to share it with the people you choose. This ends when you delete the content or your account, except where others already have a copy you shared with them (for example messages) or we must keep it by law.
7. Acceptable use
You must not:
- harass, threaten, bully or abuse anyone, or post hateful, sexual or explicit content;
- post content that’s illegal, misleading, dangerous, or that infringes someone else’s rights, including copying another person’s programs;
- spam, scam, or try to take payments outside GoatGauge for programs sold on it;
- abuse free tasters, for example by creating multiple accounts;
- access accounts or data you’re not allowed to, interfere with or overload GoatGauge, or scrape, copy or reverse engineer it;
- use GoatGauge if you’re under 16 or if we’ve suspended you.
8. Reports, removal and suspension
You can report programs, reviews, events, messages and people from inside the app. We review reports and may remove content, take down programs, hold payouts, or suspend or close accounts that break these terms or the law, or that put others at risk. Where we can, we’ll tell you why and let you respond. If you think we got it wrong, contact support@goatgauge.com. If a program you bought is taken down, you keep access to the version you bought unless it’s unlawful or unsafe to do so.
9. Ending your account
You can delete your account at any time from More → Privacy & data (how to delete your account). Cancel store subscriptions first so you aren’t charged again. If you own an organisation, hand it over or close it before deleting your account. We may close accounts as described in section 8, or if GoatGauge closes, giving reasonable notice where we can.
10. GoatGauge itself
GoatGauge, its software, design and brand belong to us or our licensors. You may use the apps for your own personal use (and, for sellers, your business on GoatGauge) in line with these terms. We work to keep GoatGauge available and secure but can’t promise it will always be uninterrupted or error-free. We may change or improve features, and will give notice of changes that significantly affect you.
11. Liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else that can’t be limited by law, and nothing affects your statutory rights as a consumer.
- We aren’t responsible for programs, coaching, events or content provided by sellers or other users, or for loss that wasn’t reasonably foreseeable.
- For business users (sellers), our total liability in any 12 months is limited to the commission we earned from you in that period, and we aren’t liable for lost profits, revenue or data.
12. Changes to these terms
We may update these terms, for example when we add features or the law changes. If a change matters, we’ll tell you in the app and ask you to agree again before you carry on. If you don’t agree, you can stop using GoatGauge and delete your account.
13. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland, Northern Ireland or the EU, you can also bring proceedings where you live, and you keep the protection of your local consumer laws. Please contact us first so we can try to sort things out.
